A. Exclusivity.
These hearing procedures are the exclusive avenue for faculty members to challenge decisions on reappointment, tenure, and promotion. The function of the Hearing Committee is to determine whether prescribed procedures were followed in making the decision and to assess whether any departures from or omissions in procedures deprived the faculty of the full and fair consideration of his or her performance and professional qualifications. The Hearing Committee does not have authority to give the faculty member a second hearing on the substantive merits of a challenged decision.
B. Timeline.
A Hearing Committee called to review a Reappointment, Tenure, or Promotion decision shall report its findings to the President and the faculty member who filed the Grievance within twenty calendar days following the conclusion of its convening.
C. President’s Review.
Upon receiving the Hearing Committee’s findings, the President may decide that further review of the Grievance is necessary. In so doing, the President must communicate that decision to the faculty member who filed the Grievance and the Hearing Committee within twenty calendar days of receiving the report of the Hearing Committee. If the President decides that the matter should be resubmitted to any stage of review, normal timetables of events and deadlines shall be waived. In this instance, all parties shall endeavor to complete the review with all deliberate speed.
D. Finality.
Decisions made pursuant to the procedures in this section are final and binding.
